Course Description:

This course surveys the law of wills and trusts. Topics include: interstate succession, wills (with an emphasis on testamentary capacity, execution, revocation, and construction), spousal/family protection doctrines, a quick overview of the more common will substitutes, and to the extent time permits, an introduction to trusts (types, creation, beneficiary's interest, creditors' rights, and modification/ termination). Materials for the course include a casebook and a California statutory supplement.  The focus will be on the California Probate Code, though there will be plenty of references to traditional common law doctrines and the Uniform Probate Code to help put the California Probate Code in context (and to help those going out of state).  Estate and gift taxation is not covered in this class.
