General Course Description:

The Patent and Trademark Clinics at UCLA School of Law teach students how to file applications before the U.S. Patent and Trademark Office (USPTO).  The clinics offer such limited legal services on a pro bono basis to entrepreneurs, small business, start-ups, and non-profits that do not have the means to hire an attorney to advise them.

Students who participate in the Patent Clinic will interview and communicate with clients, take initial patent disclosures, conduct a preliminary novelty search, render a patentability opinion, prepare a provisional or non-provisional patent application when appropriate, draft Office action responses, conduct examiner interviews when appropriate, review and finalize a patent application with the client, and file the application with the USPTO.  A licensed California attorney with USPTO registration will provide students guidance but students will have primary responsibility for their cases.

Clinic participation requires enrollment and participation in weekly class meetings that focus on the lawyering skills and substantive law necessary to effectively represent clients. In addition to discussing client interviewing and counseling techniques, students will also focus on substantive and procedural areas of law that are relevant to students’ cases and to patents in general, including issues of professional responsibility.
