General Course Description:

This seminar will address theoretical questions about contract law. Topics will include: the relationship between contract and promise; contract remedies; economic analysis of contract law; contract law and distributive justice; non-legal enforcement mechanisms; misrepresentation; and duress. Assessment will be based on class participation, several short reaction papers, and a longer response paper due at the end of the semester. Credit for the SAW will be available (and for the law and philosophy program writing requirement); students interested in satisfying either or both of those requirements will be asked to hand in a draft of their substantial paper (in place of the longer response paper) and engage in a thorough revision.
